General terms and conditions for use of youarespecial.gifts

 

1. General provisions

YOU ARE SPECIAL LTD (owner of the website youarespecial.gifts) offers the Internet user (hereinafter referred to as - User) - the use of the website youarespecial.gifts under the conditions set forth in this User Agreement (also - Terms of Use, abbreviated UP). The Agreement enters into force from the moment the User gives his consent to the terms and conditions in the manner provided in point 1.2 of the Agreement.

1.2. 5.1. By placing an order for a product and/or service from the websites owned by the Supplier, you agree that your personal data will be used by us in accordance with and in compliance with the Personal Data Protection Act only in the cases described below.

6. Release of Warranties

6.2. YOU ARE SPECIAL LTD does not guarantee that: the service meets / will meet the User's requirements; the service will be provided continuously, quickly, reliably and without errors; the results that can be obtained through the service will be accurate and reliable and can be used for any purpose or in any capacity (for example, to establish and / or confirm facts); the quality of any product, service, information, etc. obtained through the service will meet the expectations of the User.

6.3. Any information and / or materials (including downloadable software, any instructions and operating guides, etc.) to which the user has access through youarespecial.gifts, the user can use at his own risk and is solely responsible for the possible consequences of the use of the specified information and / or materials, including for the damage it may cause to the user's computer or to third parties, for loss of data or other damages.

6.4. YOU ARE SPECIAL LTD is not responsible for any losses incurred as a result of the use of youarespecial.gifts or its individual parts or functions.

 

7. Complaints and product returns

7.1. A user who ordered a product through the system and received it by courier has the right to refuse receiving the order or part of it, only in the following cases:

- during transportation, the product or its packaging is damaged (a protocol must be concluded with the courier for damaged goods)

- the pre-agreed delivery deadline has not been met;

- the delivered product clearly does not correspond to the one ordered by the customer;

- the price does not correspond to the one originally offered;

7.2. The user has the right to return the product within 14 days of receiving it. The costs of returning the product are borne by the User.

7.3. The 14-day right of refusal under item 7.2 does not apply to the delivery of goods made to the order of the user or according to his individual requirements. All products made with the User's photos, his designs, texts or other graphic elements are considered such goods.

 

8. Other provisions

8.1. This Agreement constitutes an Agreement between the User and YOU ARE SPECIAL LTD regarding the manner of using youarespecial.gifts and supersedes all previous agreements between the User and YOU ARE SPECIAL LTD.

8.2. This agreement is governed by and constructed in accordance with the laws of the Republic of Bulgaria. Matters not regulated by this agreement shall be resolved in accordance with the legislation of the Republic of Bulgaria. All possible disputes arising from the relations regulated by this agreement are resolved in accordance with the procedure established by the current legislation of the Republic of Bulgaria, according to the norms of the Bulgarian legislation. In the text of this agreement, unless expressly stated otherwise, the term "legislation" means both the legislation of the Republic of Bulgaria and the legislation of the user's place of residence.

8.3. Nothing in the agreement can be understood as establishing between the user and YOU ARE SPECIAL LTD such as intermediation relations, partnership relations, joint business relations, personal employment contracts or other relations that are not expressly provided for in the agreement.

8.4. If, for one reason or another, one or more of the provisions of this Agreement are found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions of the Agreement.

8.5. Inaction on the part of in the event of a violation by the User or other users of the provisions of the Agreement does not deprive the right to take appropriate actions to protect its interests at a later date, and also does not mean a waiver of its rights in the event of subsequent similar or similar violations.
